1. organizer

The organizer is the company NIKIN AG, Sägestrasse 46, 5600 Lenzburg.  

2. participation

Residents of Switzerland, Germany and Austria who are at least 18 years old or of legal age at the time of entry are eligible to participate. Employees of NIKIN AG and other persons involved in the conception and implementation of this competition are excluded from participation. The contest is not affiliated with, sponsored, endorsed or organized by Facebook, Instagram and other social networks. The organizer reserves the right to exclude participants who are suspected of participating in violation of the terms and conditions of participation. There is no entry fee and no obligation to purchase. The promotion will run as long as stated in the post on the social media platform. Participation is possible during the entire promotion period. Persons who use unauthorized aids or otherwise gain advantages through manipulation will be excluded from the competition. In such cases, prizes may be subsequently disallowed and reclaimed.  

3. prize and profit management 

Only the prize described in more detail in the competition will be awarded. The awarding of the prizes will take place only among the participants, cash payment of non-cash assets or exchange of the prizes is not possible. The winner accepts necessary changes in the prize due to other factors beyond the control of the companies involved in the contest. Unless otherwise stipulated in writing by the organizer of the promotion, the prizes will be awarded directly to the winners only. Potential winners will be notified by NIKIN AG. The winners are obliged to contact NIKIN AG within three days of the date and time stamp of the message sent by NIKIN AG, in compliance with the modalities specified in the competition announcement. If the claim to a prize is not made within seven days from the first notification to the organizer, the organizer reserves the right to cancel the claim to the prize and to allocate the prize to a reserve winner. No liability will be accepted for lost, late, incorrect, damaged, misdirected or incomplete claims or claims that cannot be delivered for technical reasons or due to delivery or other reasons. 

4. payment prices 

For cash prizes and value vouchers with a value of more than CHF 1,000, the organizer will deduct 35% of the prize (withholding tax) before transferring it to the winner. The winner will receive a confirmation from the organizer to reclaim the withholding tax, which must be enclosed with the personal tax return. The winner is obliged to declare winnings above CHF 1,000 in his personal tax declaration. For prizes in kind with a value of more than CHF 1,000, the winner must send the organizer a confirmation of residence, which he must obtain at his own expense from the responsible official office. The prize cannot be handed over to the winner before the confirmation of residence has been sent. If the confirmation of residence is not submitted within the deadline (within a maximum of 10 working days), the prize will be forfeited without entitlement to compensation. The winner is obliged to declare in-kind winnings with a value of more than CHF 1,000 in his/her personal tax declaration. 

5. data protection 

NIKIN AG undertakes to comply with the statutory provisions on data protection. The personal data obtained in connection with the competition will not be disclosed to third parties or made available to them for use. An exception is the winner, who gives his/her consent to the public use of his/her name, nickname, age, picture and video for advertising purposes. The contributions provided (e.g. photos, videos, texts, etc.) are not considered confidential and by participating in the competition, the participant declares that he/she has the full rights to use them. The participant also agrees that the organizer may shorten contributions, correct spelling mistakes and use the contributions for marketing and for its own advertising purposes (e.g. websites, media platforms, printed works, etc.). By participating in a competition, the participant expressly agrees to receive advertising messages from the organizer for an indefinite period of time (e-mail, post). The participant can immediately stop the sending of advertising messages at any time and free of charge by notifying the organizer (by telephone, e-mail, post, etc.). 

6. exclusion 

The organizer reserves the right to verify participants and winners before awarding a prize. This includes, but is not limited to, name, age and residence. The Promoter may refuse to award a prize or withdraw the prize claim and refuse further participation in the Promotion if there is reason to believe that these Terms and Conditions or instructions forming part of the Terms and Conditions have been breached, or if a participant has gained an unfair advantage or won by fraudulent or otherwise manipulative means by participating in the Promotion. 

7. liability

The organizer is released from all obligations upon delivery or mailing of the prize to the winner. The organizer shall not be liable for any loss, delay or damage to the prize in transit or in the post caused by circumstances beyond the organizer's control. The organizer is not liable for legal and/or material defects of the prize. The announcement of the winners is made without guarantee. No liability is accepted for lost, damaged, misdirected, incorrect or late entries, or for any technical difficulties that may affect the final result of the competition or participation. 

8. early termination or changes  

The organizer reserves the right to cancel or prematurely terminate the competition at any time without prior notice and without giving reasons. This applies in particular if proper execution cannot be guaranteed for technical or legal reasons. In such a case, the participants are not entitled to any claims against the organizer.   

9. other

The legal process is excluded. No correspondence will be entered into. All costs, taxes and fees associated with winning a prize shall be borne by the winner. All disputes arising in connection with this competition are subject exclusively to Swiss law. The place of jurisdiction is at the registered office of NIKIN AG. Should any of these provisions be or become invalid, the validity of the remaining conditions of participation shall not be affected. These conditions of participation may be amended or withdrawn by NIKIN AG at any time without separate notification.
